Terms & Conditions
Bite Resale
Effective date: 3 September 2026
1. Scope and Acceptance
These Terms and Conditions (“Terms”) govern access to and use of biteresale.com (the “Website”) and purchases made through Bite Resale. The Website is operated by OPERA ENGINEERING FZ-LLC (“Bite Resale”, “we”, “us” or “our”). By placing an order, creating an account, or otherwise using the Website, you agree to these Terms.
These Terms are intended primarily for customers purchasing in the United Arab Emirates (“UAE”). Mandatory rights available to consumers under applicable UAE law are not excluded, restricted or waived by these Terms. If any provision conflicts with a mandatory rule of UAE law, the mandatory rule will prevail to the extent of the conflict.
2. UAE Consumer-Law Framework
Our consumer transactions are subject, where applicable, to UAE legislation including Federal Law No. 15 of 2020 on Consumer Protection (as amended), Cabinet Resolution No. 66 of 2023 concerning its Executive Regulations, and Federal Decree-Law No. 14 of 2023 concerning Trading by Modern Technological Means, together with other applicable UAE laws and regulations.
Nothing in these Terms limits a consumer’s statutory remedies in relation to goods that are defective, damaged, incomplete, materially inconsistent with their description, supplied contrary to applicable law or the agreed digital contract, or delivered so late that the goods can no longer reasonably be used for their intended purpose.
3. Marketplace, Third-Party Fulfilment and Our Responsibility
Bite Resale operates an online marketplace/e-commerce platform. Products may be sourced, stored, packed, fulfilled and/or delivered by third-party suppliers, fulfilment centres, couriers or logistics partners on our behalf. Accordingly, a parcel may be dispatched directly by a third party rather than from premises operated by Bite Resale.
Use of third-party fulfilment does not remove any responsibility that cannot lawfully be excluded. Where Bite Resale is the supplier or is legally responsible for a transaction made through its platform, Bite Resale remains responsible to the extent required by applicable UAE law, including in relation to defects in goods offered through a third party using the platform.
4. Eligibility and Customer Information
You must have legal capacity to enter into a binding contract. You must provide accurate, current and complete billing, delivery and contact information. You are responsible for ensuring that the delivery address, telephone number and other order details are correct before submitting an order.
We may refuse or cancel an order where reasonably necessary, including where a product is unavailable, a price or product information contains an obvious error, payment is not authorised, fraud or misuse is suspected, delivery is not reasonably possible, or the transaction would breach applicable law. If we cancel after receiving payment, we will refund the amount due using the original payment method unless another lawful method is agreed.
5. Product Information and Availability
We aim to display product descriptions, photographs, specifications, availability and prices accurately. Images may be illustrative and colours can vary depending on screen settings. Material characteristics, dimensions, compatibility, included accessories and other key specifications shown on the relevant product page form part of the product information.
Availability may change without notice. Adding an item to a cart does not reserve it. Where an ordered item becomes unavailable, we may offer a replacement only with your agreement or cancel the affected item and refund the corresponding amount.
Where required by applicable UAE law, product information and consumer-facing contractual information must also be made available in Arabic. An English version may be provided alongside Arabic.
6. Prices, VAT and Payment
Unless clearly stated otherwise, prices displayed for UAE customers are in United Arab Emirates dirhams (AED). Applicable VAT and any mandatory charges will be disclosed in accordance with UAE law and, where applicable, included or separately identified before order confirmation.
Available payment methods are those displayed at checkout. You authorise us and our payment service providers to process the amounts shown at checkout. We do not guarantee that every payment method will be available for every order.
If an obvious pricing or technical error occurs, we may contact you before fulfilment to correct the order or cancel it and issue a refund. We will not use this clause to avoid a valid advertised price where doing so would violate applicable consumer-protection law.
7. Order Formation
Submitting an order is an offer to purchase the selected products. An automated acknowledgement confirms receipt of your order but does not necessarily mean that the order has been accepted. Acceptance occurs when we confirm the order for fulfilment/dispatch or otherwise expressly accept it. Separate items may be accepted and dispatched separately.
Electronic records, order confirmations and other digital communications may be used as evidence of the transaction to the extent permitted by applicable law.
8. Delivery in the UAE
Our standard delivery target within eligible UAE areas is same-day delivery up to 3 business days from order confirmation, depending on the product, stock location, order cut-off time, destination and fulfilment/logistics partner. Same-day delivery is not guaranteed unless expressly stated as guaranteed for the relevant order at checkout.
Business days generally exclude UAE public holidays and any other days on which the relevant carrier or fulfilment partner does not operate. Estimated delivery periods are estimates unless expressly stated otherwise or unless applicable law requires a specific commitment.
Delivery may be delayed by events outside our reasonable control, including severe weather, road restrictions, government measures, carrier disruption, incorrect customer information, inaccessible premises or other force-majeure events. We will take reasonable steps to communicate material delays.
If a delay makes the goods unusable for their intended purpose or otherwise gives you a statutory right to return, cancel or obtain a refund under UAE law, that statutory right remains available.
9. Inspection on Delivery
Please inspect the parcel and product promptly after delivery. If an item is damaged, incomplete, defective, incorrect or materially different from its description, contact us as soon as reasonably possible at info@biteresale.com and provide the order number, a description of the issue and, where reasonably available, photographs or video showing the condition of the item and packaging.
Failure to report immediately does not remove any mandatory statutory right that cannot lawfully be waived. We may request reasonable evidence to assess a claim, but we will not impose evidentiary requirements that unlawfully prevent a consumer from exercising statutory rights.
10. Voluntary Change-of-Mind Returns
In addition to mandatory UAE consumer rights, Bite Resale offers eligible consumers a voluntary 14-calendar-day change-of-mind return period beginning on the date the product is delivered.
To qualify for a voluntary change-of-mind return, the item must generally be unused beyond what is reasonably necessary to inspect it, in resalable condition, complete with accessories, manuals, labels and original packaging where reasonably possible. You must contact info@biteresale.com within the 14-day period before sending the item.
For a return based solely on change of mind, reasonable return-shipping costs may be borne by the customer where this was clearly disclosed and where permitted by law. We will tell you the applicable return method and destination before the item is sent. Do not send a return to the company’s registered address unless we specifically instruct you to do so.
The voluntary policy does not reduce or replace statutory rights for defective, damaged, incomplete, misdescribed or otherwise non-conforming goods.
11. Exceptions to Voluntary Change-of-Mind Returns
Subject always to mandatory UAE law, the voluntary change-of-mind policy may not apply to:
- goods that have been used beyond what is reasonably necessary to inspect them, or materially damaged after delivery by the customer;
- personalised, custom-made or made-to-order goods where return for change of mind is not reasonably possible;
- sealed hygiene, health or personal-care goods once unsealed, where return would create a genuine hygiene or safety issue;
- perishable goods or goods with a short shelf life;
- digital content, software, books, films or similar content once used, accessed, activated, viewed or consumed where applicable law permits the exclusion;
- gift cards, vouchers or similar stored-value products after use or redemption; and
- any other category that may lawfully be excluded from a voluntary return under applicable UAE law.
These exceptions do not exclude remedies that UAE law requires us to provide when a product is defective, damaged, incomplete, misdescribed, unsafe or otherwise non-conforming.
12. Defective, Damaged, Incorrect or Non-Conforming Goods
Where a product is defective, damaged, incomplete, incorrect, materially contrary to its description, or otherwise non-conforming in circumstances covered by UAE law, the customer may be entitled to repair, replacement, return, refund or another remedy required by applicable law.
Where the failure results from circumstances for which the supplier is legally responsible, the consumer’s statutory remedies will be provided without an unlawful charge. Where UAE law gives the consumer a choice between refund, replacement or repair, we will respect that choice to the extent required by law.
We may arrange collection, provide return instructions or direct the customer to an authorised service/fulfilment point. Third-party fulfilment does not by itself remove Bite Resale’s legal responsibility where applicable.
13. Exchanges
For eligible change-of-mind requests, exchanges are subject to stock availability. If the requested replacement is unavailable, we may process an eligible refund instead. For defective or non-conforming goods, exchange/replacement rights will be handled in accordance with applicable UAE law.
Any price difference for a voluntary exchange will be communicated before completion. Statutory remedies for non-conforming goods will not be made conditional on paying an additional amount where the law requires the remedy to be provided without charge.
14. Refunds
Once an eligible return has been received and, where appropriate, reasonably inspected, we will process the refund without undue delay. Refunds will ordinarily be issued to the original payment method. The time for the refunded amount to appear may depend on the bank, card issuer or payment provider.
For valid statutory claims concerning goods for which we are responsible, we will refund amounts, including any delivery or return costs that must legally be borne by us, in accordance with applicable UAE law.
For voluntary change-of-mind returns, original delivery fees and return costs are refundable only where required by law or expressly stated by us. Any lawful deduction for loss in value caused by handling beyond what is reasonably necessary to inspect an item will be assessed fairly and transparently.
15. Order Cancellation Before Dispatch
If you wish to cancel an order before dispatch, contact info@biteresale.com immediately. We will make reasonable efforts to stop fulfilment, but cancellation cannot be guaranteed once the order has entered packing, dispatch or courier processing.
If cancellation cannot be stopped, you may use any applicable return rights after delivery. This clause does not restrict any statutory cancellation, return or refund right available under UAE law.
16. Failed Delivery, Incorrect Address and Unclaimed Orders
If delivery fails because information supplied by the customer is materially incorrect, the customer is unavailable after reasonable delivery attempts, or the customer refuses an otherwise conforming order without a legal basis, we may charge reasonable, disclosed re-delivery or return costs to the extent permitted by law.
We will not impose such charges where the failed delivery is caused by us, our supplier, fulfilment partner or carrier, or where doing so would conflict with mandatory consumer law.
17. Warranties and After-Sales Support
Any manufacturer, commercial or product warranty displayed on the product page or supplied with the product is additional to mandatory consumer rights and does not replace them. Warranty terms, duration, territorial coverage and exclusions may vary by product.
Where UAE law requires a remedy, warranty or after-sales obligation, it will be honoured notwithstanding any inconsistent limitation in a manufacturer’s or third party’s terms.
18. Customer Accounts
If accounts are available, you are responsible for maintaining the confidentiality of your login credentials and for activity carried out through your account, except to the extent caused by our breach or circumstances for which you are not legally responsible. Notify us promptly if you believe your account has been compromised.
We may suspend or restrict an account where reasonably necessary to protect customers, prevent fraud, comply with law or investigate misuse. We will act proportionately and will not use account suspension to avoid valid consumer obligations.
19. Acceptable Use
You must not misuse the Website, attempt unauthorised access, introduce malicious code, interfere with Website operation, scrape or reproduce protected content unlawfully, submit fraudulent orders, abuse promotions or returns, impersonate another person, or use the Website for unlawful purposes.
20. Intellectual Property
Unless otherwise stated, the Website, its layout, branding, text, graphics, software and other original content are owned by or licensed to Bite Resale and are protected by applicable intellectual-property laws. Product names, trademarks and images belonging to third parties remain the property of their respective owners.
You may use the Website for personal, lawful shopping purposes. No intellectual-property right is transferred to you by access to the Website or purchase of a product.
21. Reviews and User Content
If you submit a review, photograph, comment or other content, it must be truthful, lawful and must not infringe third-party rights. You grant us a non-exclusive, worldwide, royalty-free licence to display, reproduce and adapt that content for operating and promoting Bite Resale, subject to applicable privacy and consumer laws.
We may moderate or remove content that is unlawful, misleading, abusive, fraudulent or unrelated to the relevant product or service. We will not manipulate reviews in a way that misleads consumers.
22. Promotions, Discount Codes and Offers
Promotions may be subject to additional terms disclosed with the offer, including validity dates, eligible products, minimum spend, usage limits and territorial restrictions. Unless expressly stated otherwise, discount codes cannot be combined. We may withdraw or correct a promotion where required by law or where an obvious technical or pricing error has occurred, without affecting orders already validly accepted where applicable law requires otherwise.
23. Privacy and Electronic Communications
Personal data is handled in accordance with our Privacy Policy and applicable UAE data-protection requirements. We may send transactional communications necessary to process orders, payments, deliveries, returns, security notices and customer-service requests.
Marketing communications will be sent only in accordance with applicable law and available consent/opt-out requirements. Consumer data will not be used in a manner prohibited by applicable UAE consumer or data-protection law.
24. Limitation of Liability
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including mandatory consumer remedies, liability arising from fraud or fraudulent misrepresentation, or any other liability that UAE law requires us to bear.
To the maximum extent permitted by law, we are not liable for indirect or consequential losses that were not reasonably foreseeable when the contract was formed, or for losses arising solely from events outside our reasonable control. For consumers, this clause applies only to the extent permitted by mandatory UAE law and does not limit compensation rights granted by such law.
25. Force Majeure
We will not be responsible for a delay or failure caused by an event outside our reasonable control, provided that we take reasonable steps to mitigate its effects and comply with any mandatory obligations. If such an event materially prevents performance for an extended period, we may cancel the affected order and refund amounts due, without limiting any stronger right provided by law.
26. Complaints and Customer Support
Complaints, return requests and customer-service enquiries may be submitted to info@biteresale.com. Please include your order number and sufficient information for us to investigate. We aim to acknowledge and resolve complaints fairly and within a reasonable time.
Consumers may also exercise any right to submit a complaint to the competent UAE consumer-protection authority. Nothing in these Terms requires a consumer to waive access to a competent authority, dispute-resolution mechanism or court.
27. Governing Law and Jurisdiction
These Terms and transactions with Bite Resale are governed by the applicable federal laws of the United Arab Emirates and, where relevant, the laws and regulations applicable in the Emirate of Ras Al Khaimah.
The competent courts of the UAE or the relevant Emirate shall have jurisdiction in accordance with applicable law. Nothing in this clause deprives a consumer of a mandatory forum, complaint mechanism or jurisdictional protection provided by UAE law.
28. Changes to These Terms
We may update these Terms from time to time to reflect legal, regulatory, operational or commercial changes. The version applicable to an order is generally the version presented when that order is placed, unless a mandatory legal change applies otherwise. Updated Terms will be published on the Website with a revised effective date.
29. Severability and No Waiver
If any provision is found invalid, unlawful or unenforceable, it will be interpreted or severed to the minimum extent necessary, and the remaining provisions will continue in effect. A delay or failure by us to enforce a right does not waive that right.
30. Language
This document is the English-language version of the Terms. UAE consumer-protection legislation requires consumer-related data, advertisements and contracts to be provided in Arabic, while permitting other languages alongside Arabic. Bite Resale should therefore publish an Arabic version of these Terms and relevant consumer/product information in addition to this English version.
If versions differ, they will be interpreted in accordance with applicable UAE law and mandatory consumer-protection requirements. No translation may be used to reduce a consumer’s statutory rights.
